Officers conducting DWI traffic enforcement on Dec. 22 stopped 38-year-old Paz Magno of Yonkers shortly before 5 a.m. on Post Road after watching him swerving and hitting the curb several times.
According to police, when the officers asked for his license, registration and insurance, he handed them his insurance card and “just sat there.” When asked if he had a license, officers said he said no. In the police report, officers said that Magno “then began to reach in his pockets and turn away as if he was going to grab something. I immediately instructed him to show me his hands, to which he did not comply,” prompting the officers to make him exit the vehicle.
Police said that Magno had the smell of alcohol on his breath and he proceeded to fail multiple Standardized Field Sobriety Tests and was arrested under suspicion of drinking at driving. At Scarsdale Police Headquarters, a breathalyzer test determined that he had a .17 percent blood alcohol content, more than double the legal limit.
Magno was charged with misdemeanor counts of driving while intoxicated and operating a motor vehicle with a blood alcohol content greater than .08 percent. He was also cited for several vehicle infractions. Following his arraignment, Magno was released on his own recognizance. He is due back in Scarsdale Village Court this week to answer the charges.
