Yonkers attorney Michael Khader stated in a letter to Mount Vernon officials that Davis "became ineligible to serve" after pleading guilty to tax evasion in October. Davis pleaded guilty after failing to file 2011 income taxes and report income earned from the sale of a property in 2003, according to the report.
The report cites Article IV, Section 25 of the City Charter, which states that, “any officer or employee who willfully violates or evades any provision of law, or of this chapter ... shall be deemed guilty of a misdemeanor and, in addition to the penalties imposed by law, shall on conviction forfeit his office or employment."
