Driver Is Charged After School Bus Stops In Chappaqua Railroad Crossing

CHAPPAQUA, N.Y. -- New Castle police have charged the driver of a school bus that was trapped at the Roaring Brook Road railroad crossing on Monday morning, just before a Metro-North train passed by.

New Castle Police said they arrested Bronx resident Nancy Peralta, 53, of Jerome Avenue, at 8:45 a.m., on charges of stopping a school bus in a railroad right of way while a train was transiting the railroad crossing. 

It's the latest incident at the Roaring Brook Road crossing. A vehicle became stuck there in early March and was able to get out after breaking the gate. Later in March, a driver of a white van crashed into the gate at the crossing.

According to New Castle police, Officer Brian Bruno was conducting traffic observation at the rail road crossing when he observed a school mini bus drive up to and come to a stop at the edge of the train tracks. The crossing gate activated and came down on top of the school bus. The driver attempted to back up, but stopped when the crossing gate became stuck on brackets protruding from the body of the bus. 

The bus was under the gate with its front end beyond the gate and inside the railroad right of way as a commuter train passed at 7:52 a.m., police said.

No collision or injuries occurred as a result of this incident, said New Castle police. 

In addition to the driver of the school bus, there were two students and a bus monitor aboard the bus at the time of the incident, police said.

Peralta was released on an appearance ticket and is due in New Castle Court on May 28.
